Terms of Service

These Terms of Service ("Terms") govern your access to and use of omnieditor.co, the Omni Editor website, and our AI image and video creation services (collectively, the "Service"). In these Terms, "Omni Editor," "we," "us," and "our" refer to the operator of the Service.

By creating an account, purchasing credits or a subscription, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Eligibility and Accounts

You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian who agrees to these Terms.

You must provide accurate account information, protect your login credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account unless it results from our failure to use reasonable security measures. You may not sell, transfer, or share access to your account in a way that circumvents account, payment, or usage limits.

The Service

Omni Editor provides tools for generating, editing, transforming, and managing images and videos using artificial intelligence. Features, models, prices, credit costs, limits, and availability may change as the Service and third-party providers evolve.

The Service may include beta, preview, experimental, or free features. Those features may be modified, limited, or discontinued at any time and may be less reliable than generally available features.

Third-Party AI Models and Services

The Service relies on third-party AI models, infrastructure, storage, authentication, analytics, email, and payment services. When you submit a generation request, the content and settings needed to perform that request may be sent to the AI gateway and model provider supporting the selected feature.

Model names and trademarks belong to their respective owners. Unless expressly stated, Omni Editor is not affiliated with, sponsored by, or endorsed by those owners. Third-party services may impose additional terms and may change or discontinue their technology without notice to us.

Your Content

"Your Content" means prompts, images, videos, files, reference materials, and other content you submit to the Service.

You retain the rights you hold in Your Content. You grant Omni Editor and our service providers a worldwide, non-exclusive, limited license to host, reproduce, transmit, modify, and process Your Content solely as reasonably necessary to operate, secure, improve, and support the Service, enforce these Terms, and comply with law.

You represent and warrant that:

• You own Your Content or have all rights, licenses, permissions, and consents needed to submit and process it
• Your Content and use of the Service do not violate law, privacy, publicity, intellectual property, contractual, or other third-party rights
• You have obtained any required consent from identifiable people depicted or recorded in Your Content

You are responsible for keeping copies of important content. We may remove content as permitted by these Terms and do not guarantee permanent storage or availability.

Generated Output

Subject to these Terms and applicable law, as between you and Omni Editor, you may use outputs generated for you for lawful personal or commercial purposes. Omni Editor does not claim ownership of your generated outputs, except for our underlying software, interface, branding, templates, and other platform materials.

AI output may be inaccurate, incomplete, offensive, unexpected, or similar to content generated for other users. We do not guarantee that an output is unique, eligible for intellectual property protection, or free from third-party rights. You are responsible for reviewing outputs and determining whether your intended use is lawful and appropriate. Do not rely on the Service for legal, medical, financial, safety-critical, or other professional decisions.

Acceptable Use

You may not use the Service to upload, request, generate, edit, transform, promote, store, or distribute any of the following six prohibited content categories:

1. Sexual, pornographic, or NSFW content, including sexually explicit material, fetish content, adult nudity, sexualized nudity, sexual solicitation, sexual deepfakes, or other content intended for sexual gratification.
2. Graphic violence, blood, or gore, including severe injury, dismemberment, torture, executions, terrorist violence, or content that glorifies extreme physical harm.
3. Hateful or extremist content that attacks or dehumanizes protected groups, promotes discrimination or violence, or supports terrorist or violent-extremist recruitment or propaganda.
4. Child sexual abuse or child-endangering content, including CSAM, grooming, exploitation, or sexualized depictions of minors or young-looking persons, whether real, fictional, illustrated, animated, or AI-generated.
5. Deceptive deepfakes, impersonation, or non-consensual intimate content that uses a real person's identity or likeness without authorization to deceive, defraud, harass, damage reputation, or create intimate material.
6. Copyright, trademark, privacy, or other rights infringement, including unauthorized use of protected works, brands, logos, characters, confidential material, or a person's likeness where permission or another lawful basis is required.

You also may not use the Service for illegal or dangerous activity, harassment, self-harm encouragement, fraud, phishing, malware, trafficking, unauthorized automated access or resale, or attempts to bypass safeguards, access controls, payment requirements, rate limits, or credit limits. These rules apply to real, fictional, illustrated, animated, synthetic, and AI-generated content, including content created for private use.

Moderation and Enforcement

We may use automated safety systems, model-provider safeguards, report review, and human operational review to detect abuse, fraud, safety risks, or policy violations. We may refuse or stop a request, block an upload or output, remove content, limit features, suspend or terminate an account, preserve relevant records, or report conduct to service providers or authorities where reasonably necessary or legally required.

To report prohibited content, suspected infringement, or misuse, email support@omnieditor.co with the subject Content Report. Include the relevant account, URL, task identifier, and a clear description. Do not send illegal or intimate content by email unless we specifically request it through a secure channel.

Reports involving child safety, credible threats, or non-consensual intimate content receive priority review. Never email, re-upload, or attach suspected CSAM when submitting a report.

Credits, Subscriptions, and Payments

Some features require prepaid credits or a paid subscription.

• The price and estimated credit cost displayed before purchase or generation apply at that time
• Credits are consumed when an eligible generation request is processed
• When our systems record a generation as failed, credits charged for that failed generation are returned to the applicable balance
• Monthly subscriptions renew automatically at the interval shown during checkout until canceled, unless stated otherwise
• Canceling a subscription stops future renewal charges but does not retroactively refund prior billing periods
• Promotional, free, subscription, and purchased credits may have different validity periods, limits, or expiration rules as disclosed when granted or purchased
• You are responsible for applicable taxes, payment-provider charges, and accurate billing information

Except where required by law or expressly stated at checkout, purchases are final and non-refundable after credits are delivered or used. If a payment is reversed, disputed, or fraudulent, we may deduct related credits, suspend the account, or recover amounts owed. We may change future pricing or credit costs, but changes will not retroactively alter a completed purchase.

Intellectual Property

The Service, including its software, interface, design, branding, documentation, and platform content, is owned by Omni Editor or its licensors and is protected by intellectual property and other laws. These Terms grant you a limited, personal, revocable, non-exclusive, non-transferable right to access the Service. They do not transfer ownership of the Service or permit use of our branding without written permission.

If you believe content on the Service infringes your rights, contact support@omnieditor.co with sufficient information for us to identify the work, locate the content, verify your authority, and evaluate the claim.

Service Changes and Availability

We may add, modify, suspend, or discontinue parts of the Service. Generation times and availability depend on third-party systems and may vary. We do not guarantee that a particular model, feature, output format, price, or level of availability will continue indefinitely.

We may schedule maintenance or impose reasonable usage limits to protect users, control costs, meet provider restrictions, or maintain service quality.

Disclaimers

To the fullest extent permitted by law, the Service and all outputs are provided "as is" and "as available." Omni Editor disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uniqueness, and uninterrupted or error-free operation.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

Limitation of Liability

To the fullest extent permitted by law, Omni Editor and its affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, opportunities, or business interruption arising from or related to the Service.

To the fullest extent permitted by law, our total liability for all claims arising from or related to the Service will not exceed the greater of US $100 or the amount you paid to Omni Editor during the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.

Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Omni Editor and its affiliates, personnel, licensors, and service providers from claims, damages, losses, liabilities, and reasonable legal fees arising from Your Content, your use of generated output, your violation of these Terms, or your violation of another person's rights.

Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created legal or security risk, failed to pay amounts due, abused refunds or chargebacks, or used the Service in a way that could harm users, providers, or our operations.

Sections that by their nature should survive termination, including sections concerning ownership, payments, disclaimers, liability, indemnity, and disputes, will remain in effect.

Changes to These Terms

We may update these Terms to reflect changes to the Service, provider requirements, or law. We will post the revised Terms and update the effective date. If a change materially affects your rights, we will provide additional notice where required. Continued use after the effective date of revised Terms means you accept them.

General Terms

If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or transfer of the Service. These Terms and the Privacy Policy are the entire agreement between you and Omni Editor concerning the Service unless additional terms are presented for a specific feature or purchase.
